Navigating the process of divorce can be complex and emotionally taxing. In Ada County, Idaho, couples opting for arbitration as a method to settle their divorce must follow specific steps to confirm their arbitration award and finalize their divorce with the District Court of the Fourth Judicial District. Step 1: Filing Process


E-filing Instructions: Available on the court's website.


Or File In Person:


1. Prepare Your Filing Package: Print and make two copies of each of the following documents:

- Family Law Case Information Sheet

- Joint Petition for Divorce & Application to Confirm Arbitration Award

- Petition

- Judgment Entering Arbitration Award & Decree of Divorce

- Acknowledgement of Service (This must be signed by the Co-Applicant after the Joint Petition is filed with the courthouse).



2. Submit Your Documents: Take the signed and dated documents to the Court Assistance Office located at 200 W. Front Street, Room 1171, Boise, ID. The staff will review your forms for accuracy and assist with the filing process.


3. Filing Fee and Copies: At the Court Assistance Office, file the originals and copies with the Clerk and pay the filing fee of $207. The Clerk will keep the originals, date stamp your copies, and return them to you (one copy for you and one for your spouse, the Co-Applicant).


4. Additional Orders: Be aware that some courts may issue temporary orders regarding property use and require attendance at parent education classes. Include these orders when serving the Co-Applicant and ensure compliance.


5. Summons and Certificate of Divorce: If given the original Summons, keep it safe for return to the court after serving the Co-Applicant. Complete the Certificate of Divorce template provided by the Clerk and return it.


Step 2: Service Process


Applicant:

1. Acknowledgement of Service: The Clerk will offer you a blank form during filing, or use the one prepared in your Filing Package. Deliver the following to the Co-Applicant:

- Acknowledgement of Service

- Stamped copy of the Petition with all accompanying documents

- Stamped copy of the Summons


Co-Applicant:

1. Complete and Return: Sign the Acknowledgement of Service, make a copy for your records, and return the original to the Applicant. The Applicant may also make two copies, giving one to the Co-Applicant.


Applicant:

1. Filing with the Court: Return to the Court Assistance Office with:

- The original Acknowledgement of Service

- The original Summons (if provided during filing)

- The original Affidavit of Service

Ask the Clerk to stamp your copy of the Acknowledgement of Service and Affidavit of Service for your records.


Step 3: Comply with Court Orders

- Both Parties: Ensure compliance with any court-issued orders regarding parenting classes and/or property use.
